ÖZETBu çalışma, Osmanlı ormancılığının XIX. yüzyıldaki hukuksal evrimini irdelemekte ve Istranca Ormanları üzerinden bu sürecin pratiklerini işlemektedir. XIX. yüzyıldaki bu süreç Tanzimat’ın ilanına kadar gitmektedir. 1840 tarihli Lâyiha ile başlatılan orman reformlarının temel misyonu bu ekosistemi kontrol altına almak ve hazineye gelir sağlamaktır. Fakat Lâyiha’nın yürürlüğe konulmasıyla birlikte bu reformlar, farklı toplumsal kesimlerden büyük tepkiler almıştır. Orman Müdüriyeti’nin nitelikli işgücüne sahip olamaması ve kadrolaşamaması bu reformların layıkıyla uygulanamamasına sebebiyet vermiştir. Öte yandan tercüme bir eser olan Lâyiha, Avrupa ülkelerinin kendi koşul ve iklimlerinde gelişim göstermiş bir kanunun Osmanlı dinamiklerine uyarlanmış bir versiyonudur. Artan tepkilere karşılık olarak Osmanlı makamları, hızlı ve hızlandırılmış bir reformda ısrar etmemiş ve politikaları uzun bir süre boyunca uygulamayı tercih etmişlerdir.ABSTRACTThis study scrutinizes the legal evolution of Ottoman forestry in the 19th century and deals with the reflections of this process in the Istranca Forests. This process in the 19th century goes back to the proclamation of the Tanzimat. The main mission of the forest reforms initiated with the Layiha of 1840 is to control the forest ecosystem and to generate income for the treasury. However, with the Code of Layiha, these reforms received a great reaction from different social segments. The Forestry Directorate did not have a qualified workforce and was understaffed, which inhibited proper implementation of the reforms. On the other hand, Layiha, a translated work, was indeed the transmission of a law that emerged in the specific conditions and climates of European countries, adapted to Ottoman dynamics. As a response to the increasing reactions, the Ottoman authorities did not insist on a fast and accelerated reform
and they rather chose to enforce the policies over a long period.
